1. Participation Requirements & Safety
In consideration of participating in or spectating an activity or program at The Shop or involving the use of tools, machinery, materials, or structures located in The Shop (“Activities”), I voluntarily agree and represent that I understand the nature of this activity, have completed any and all safety and technical training as required by Princess Auto, and I agree to follow all instructions provided by the on-site Team Members. I further warrant that I am not under the influence of alcohol or drugs, and I am in proper physical condition to participate in the Activities.
2. Assumption of Risk & Responsibility
I understand and acknowledge that my participation in the Activities involves inherent, unlikely and unforeseeable risks. I knowingly and voluntarily accept and fully assume all risks of any kind or nature, known or unknown, arising from or in connection with my participation in the Activities and the possibility of personal injury, death, liability, property damage or loss of any kind or nature resulting therefrom. Princess Auto assumes no risk or liability for my participation in the Activities, and I participate at my sole discretion and risk. I am responsible for any damage to or loss of any equipment, property, or structures of any kind used in connection with the Activities. I further warrant that I have all rights, licences, permissions, and authority necessary to create, reproduce, modify, use, and design all materials, or other works created in The Shop, and my use of such items shall not infringe, misappropriate, or violate any third-party intellectual property, contractual, or other rights.
3. Release of Liability & Indemnification
I voluntarily and knowingly agree on behalf of myself, and my spouse or partner, heirs, executors, administrators, invitees, representatives, successors, assigns and anyone else that may make or have a claim, action, suit, demand, right of action, obligation, or damages of any kind or nature, known or unknown, (“Claims”) by or through me to: (1) fully and forever release, waive, and discharge Princess Auto Ltd and its directors, agents, affiliates, officers, volunteers, employees, independent contractors, hosts, instructors, other participants, sponsors, advertisers, and if applicable, owners and lessors or premises on which the Activities take place, and all of their respective personal representatives, successors, and assigns (“Princess Auto”) from and against all liability from any and all Claims, that I have now or may have in the future; and (2) fully indemnify and hold Princess Auto harmless from and against any and all Claims, including third party claims and, for greater certainty, legal parents and guardians of the minor child agree, to fully indemnify and hold Princess Auto harmless from and against any and all Claims brought by or on behalf of the person participating in the Activities; for any personal injury, death, loss, damage, cost, fee, penalty, or expense, of any kind or nature, arising out of or in connection with my (and for greater certainty, if applicable, my minor child’s) participation in the Activities, due to any cause whatsoever. This Indemnification & Waiver and Release of Liability provision will survive indefinitely.
